This study refers to a recent feature under which a great many would-be immigrants claim a residence permit on the basis of a lack of medica! services in their country of origin. It may be persons with the AIDS virus, a post-traumatic stress syndrom or tuberculosis, to name but a few. The question needs to be posed whether there is a right to health, and if so, if this has a cross-border effect.
It is submitted that the divide between first and second generation of humán rights basically results in the absence of obligations for the country where assistance and/or protection is being sought to provide care, not to mention cure, but for somé specifíc cases. It is submitted that Europe should take urgent action in developing medical data-banks and in agreeing harmonized norms and criteria. Strasbourg case-law would hereto form a workable... Tovább

J. van Krieken (Oegstgeest, the Netherlands) spent more than 16 years with the UNHCR (inter alia as UNHCR's Deputy Régiónál Representative for the Nordic and Baltic Countries, and as Head of the UNHCR Offices in Juba (Southern Sudan) and Peshawar (Pakistan)). He now works with the Netherlands Ministry of Justice, Immigration and Naturalization Service, as Special Advisor in International Affairs.
